Getting the Deal Through – Vertical Agreements

9 March 2023

Sarah Beeston, Pim Jansen and Nina Korstenbroek have written again the Dutch chapter of the book Getting the Deal Through – Vertical Agreements. This is an international guide with contributions of local experts from several jurisdictions worldwide. The book describes how competition law rules are applicable to vertical agreements.

Important subjects are for example: who is the responsible competition authority and what are its investigative powers? What consequences follow a breach of the relevant rules (risk of the contract being void and (considerable) fines)? We also cover the changes that follow from the new EU Vertical Block Exemption Regulation. We naturally describe the relevant developments in this area in the Netherlands, including a short analysis of the considerable fine the Dutch Authority for Consumers and Markets imposed on Samsung.

The chapter is relevant for anyone dealing with distribution, agency, franchise or any other vertical agreement and is available here.

Please contact us for any questions about the application of the rules to your (wishes in relation to a) contract.
