The Proposed New Dutch Arbitration Act

Last March the Dutch Ministry of Justice published a preliminary version of the legislative proposal for revision of the Dutch Arbitration Act (the Proposal). The publication of this document serves the purpose of consulting the market on the contemplated revisions of the Dutch Arbitration Act (DAA) before the legislative proposal is offered to Parliament.
The DAA has been in force since December 1, 1986. Developments in the (international) arbitral practice have led to a need for modernisation of the DAA. Although the preliminary version of the Proposal is still quite some time from being enacted—the new Arbitration Act is envisaged to come into force on January 1, 2014—the Proposal is indeed expected to be passed with relatively few amendments. This is also due to the fact that the proposal builds on a report on the revision of the Dutch Arbitration Act by a commission presided over by Professor A.J. van den Berg, a leading practitioner in the field.
